These General Terms and Conditions of Sale (GTCS) govern the contractual relationship between Somôme, operator of the website www.somome.com, and any natural or legal person wishing to make a purchase via the website.

2. Purpose

These General Terms and Conditions of Sale define the conditions under which products are sold by Somôme to individual customers via the website. They govern all the steps necessary to place an order and ensure the follow-up of that order between the contracting parties.


3. Acceptance of the Terms

The customer acknowledges having read the General Terms and Conditions of Sale at the time of placing the order and expressly accepts them without reservation. These terms are enforceable against the buyer in accordance with Article 1119 of the French Civil Code.


4. Products

The products offered for sale are described as accurately as possible. However, photographs are for illustrative purposes only and have no contractual value.
Somôme reserves the right to modify its product range at any time.


5. Prices

Prices are indicated in euros (€), all taxes included (VAT), excluding delivery costs.
Somôme reserves the right to change its prices at any time, but products will be invoiced based on the rates in force at the time the order is recorded.


6. Orders

An order is considered valid once payment has been confirmed.
Somôme reserves the right to cancel or refuse any order in the event of a dispute with the customer.


7. Payment

Payment is made using the payment methods offered on the website. Transactions are secured by a certified payment service provider.
The order will be processed only after payment has been validated.


8. Delivery

Products are delivered to the address provided by the customer when placing the order.
Delivery times are given for information purposes only. Any delay cannot justify cancellation of the order or give rise to compensation or damages.

In the event of a damaged product, the customer must immediately notify the carrier and then contact our customer service within 48 hours.


9. Right of Withdrawal

In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 calendar days from receipt of the order to exercise the right of withdrawal, without having to justify the decision or incur any costs other than return shipping costs.

To exercise this right, the customer must notify their decision by email at contact@somome.com. The products must be returned in perfect condition and in their original packaging.


10. Legal Warranties

All products benefit from the legal warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).


11. Personal Data

The information collected is necessary for order processing and the management of the commercial relationship. It is processed in accordance with the GDPR.
The customer has the right to access, rectify, object to, and delete their personal data.

12. Intellectual Property

All elements of the website are the exclusive property of Somôme or their respective authors. Any reproduction, use, or exploitation, even in part, is strictly prohibited.


13. Applicable Law and Disputes

These terms and conditions are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority. Failing that, the competent court shall be that of the defendant’s place of residence or, at the consumer’s choice, the place of delivery.
